4. ... (though the evidence was unrebutted all those things would happen). It wasn’t about my getting Kentucky’s Commissioner of Public Health to actually admit under oath that several of the regulations he issues had no rational basis...
5. ... (though I am still sort of shocked that happened). Or his admission that some of the restrictions we challenged won’t make a big difference in terms of additional covid spread if they are lifted somewhat (though that happened).
6. Or the Attorney General putting in economic testimony about irreparable multi billion dollar losses to Kentucky’s economy due to these orders (that happened too). It wasn’t about Kentucky’s Labor Secretary admitting under oath we have taken an advance of $100,000,000...
7. ... from Kentucky’s unemployment allocation from the federal government from future months that we cannot pay back if the economic consequences from these order happen and we permanently lose these Kentucky businesses (though that happened also).
8. It also wasn’t about the substance of those public orders. It was fundamentally about the process and Constitution and checks and balances.

And if the Governor and his staff believe they actually need powers beyond those actually given to them by the legislature...
9. ... (which they haven’t used, instead abusing the emergency response powers), they need to work with the legislature. They may need to call a special session. They may need to consult with the legislature. They may need to discuss the steps they are taking...
10. ... with the legislative leaders, and obtain buy in. Because they haven’t done that to date.

Our system of Government requires that the legislative branch, not the executive branch, legislate – make the laws. The executive enforces the laws.
11. And judicial branch is the referee. Those separation of powers is how our government is designed to protect liberty.

The Court found that the Governor was legislating by decree (he was), and he can’t be doing that.

12. ... regulations for health and safety standards. Yes, they do not allow complete business shutdowns, but they allow the Governor to enact some fairly protective measures for the public health.
