Even with the stay & the writ proceedings, Sullivan has kept the Brady Order active so DOJ must continue handing over exculpatory evidence & we keep learning more!
How do you get evidence exposed? On the court record!
On 7/7/20, DOJ provided 14 pages of evidence that we have already seen listed as notes from several meetings!

But now we get to see the details of that evidence.

Thank you Judge Sullivan!
So remember when DOJ filed the motion to dismiss in May saying there was no prosecutorial misconduct?
Remember in June when the Solicitor General & DOJ told 2nd Circuit court there was no prosecutorial misconduct.

Monday DOJ handed over evidence of prosecutorial misconduct!
Strzok & Tasha's notes show that on 1/25/17 FBI & DOJ knew Flynn statements were not material. Yet Van Grack told the court they were material & the evidence to the contrary was hidden from Flynn's defense team for more than 3 years.
Those documents might have been hidden forever without Sullivan refusing to accept a motion to dismiss that claimed there was no prosecutorial misconduct.
This looks remarkably like evidence of a coup and crimes by Acting AG Yates, Acting AAG for National Security McCord, FBI Deputy Director McCabe & his Special Counsel Lisa Page.
10 FBI & DOJ officials attended a meeting on 1/25/17 in which Stzrok briefed everyone (along with other I'm sure) so they were all aware that the information on Flynn was all exculpatory!
McCabe is toast!
Agents who interviewed Flynn were quoted as saying that they “believe[d] that F. believe[d] that what he said was true.”

They knew Flynn wasn't lying on 1/25/17!
The falsified 302 differs from the notes on 1/25/17 the day after the interview. During the meeting they say Flynn did not remember how many calls he made. But the falsified 302 that McCabe approved says he remembered it was 4-5 calls.
DOJ slammed the door on McCabe's crew on the Logan Act.

DOH's George Tosca wanted to knwo what business FBI had telling the WH to stop making false statements to the media! Yet that is what McCabe, Yates & McCord went to the WH about AFTER this meeting!
Sidney finally got around to talking about an issue discussed in this corner of twitter for awhile, the bait & switch over expulsions & sanctions in the DOJ's case against Flynn.
We also get some excerpts from the 1/30/17 DOJ memo that cleared General Flynn of being a Russian agent.

Defense was notified of the memo but only got a heavily redacted version this week. Was it grand jury evidence against those who framed Gen Flynn?
Of course Sydney uses these late disclosures as ammo for approving the motion to dismiss.

BUT they now serve as evidence of irregularity of DOJ conduct in the case, the thing the Circuit Court argued Sullivan did not have in the record of the case to justify questioning DOJ!
That January 30, 2017 memo must be interesting!
Very interesting indeed.
They certainly used a lot of black ink!

But they did leave the Special Counsels' Office document number on the bottom of it. So Van Grack's team had this document when they prosecuted Flynn...
Dana Boente's notes from his 3/30/17 phone call with @Comey are similarly redacted. Also bear the mark of the Special Counsels Office.
