India loses crucial argument in case relating to shooting of two fishermen by Italian marines in 2012. @PCA_CPA rules India has no criminal jurisidiction over marines
Italy’s strategy of taking its marines case to international fora and remove India’s jurisdiction has succeeded. It has obtained immunity for its marines and cessation of criminal proceedings in India.
Decision accepts Italy’s commitment to resume its criminal investigation into incident of Feb 15, 2012, and that India must cease to exercise criminal jurisdiction. Effectively ends all efforts to prosecute Chief Master Sergeant Massimiliano Latorre and Sergeant Salvatore Girone
Thanks to a unanimous ruling that Italy breached India’s freedom and right of navigation u/Art. 87 and 90, India is entitled to compensation for death, loss of property, physical and moral harm
@PCA_CPA does finds that Italy breached India’s rights under UNCLOS (law of the sea convention) to protect its EEZ and also that India did not violate its Art.100 obligation (cooperation in repression of piracy). However, loss of criminal jurisdiction is a huge setback.
