This one will require some unpacking:
Judge Preska is presiding over two Jeffrey Epstein-related cases.
* One is a battle to unseal documents from Giuffre's case against Maxwell, which the 2nd Circuit ordered public last year. https://www.courthousenews.com/court-orders-sunlight-on-huge-tranche-of-jeffrey-epstein-files/

* The other is Giuffre's defamation case against Dershowitz, where both sides want to use documents from the Maxwell litigation for the lawsuit and defense. https://www.courthousenews.com/epstein-accuser-wants-more-defamation-claims-against-alan-dershowitz/
At a recent telephone conference, Dershowitz asked the judge to modify the protective order in the first case to boost his defense in the second.
It also came out that his accuser's legal team already has most of the files that he wants.

Instead of giving both sides the documents, the judge gave neither.
"While the court rejects Mr. Dershowitz’s request to modify the Maxwell protective order, it will not in the same breath force him to litigate this action with one arm tied behind his back," her footnote reads.

Important context:
The documents in the Maxwell case are still a part of the ongoing unsealing fight.
On a quick read, this order appears to mean that unless and until those documents are unsealed, they won't come out in Giuffre's suit against Dershowitz.

To be absolutely clear, the records still exist. The judge just ruled that neither can have them for the purposes of this litigation.
