According to DCCA Rule 35 - Petition for hearing or rehearing en banc, Judge Sullivan who is NOT a party to the case is NOT therefore entitled to request en banc.
That is reserved for
a) A majority of the Court of Appeals active 11 judges
b) The parties

For appeals court judges to request en banc, one of the judges must request a vote.

So what next
It wouldn't surprise anyone if dissenting Judge Wilkins requests a rehearing en banc vote.
He needs all 5 of his fellow democrat appointees to agree to it, and they have some high hurdles to jump to justify it.

Will this EVER be over
Remember, any of the appeals judges can petition for en blanc rehearing.
IF the Court of Appeals is as Partisan as many fear, the game is DELAY DELAY DELAY so we are likely to see a petition on deadline date as defined by RULE 40.

The DC Courts can ill afford anymore scandals, and the Judges would do well to seriously consider the consequences of allowing an En Banc rehearing of the Flynn Case.
I hope we're celebrating the end of this fiasco by July 9, 2020
