Here is one of many "cops lie" stories.

Last summer, I did a DWI trial where my client was accused of getting into an accident by striking a police vehicle that was in the shoulder portion of a highway.

This happened during a snowstorm. It had snowed about 4.6 inches of snow that night. The roads were icy and slick.

One officer came in testified that the roads were clear, there was no snow or ice anywhere on the roads.

This officer was on snow patrol until 10 minutes before the car accident. He bizarrely testified on cross that the roads were not icy or slick, and it was just a dusting of snow. Officer basically testified he was plowing straight concrete for 6 hours.

/3
I impeached the officer with his own memobook, where he described the roads as "icy." Officer claimed he meant "the weather was icy."

Which is not a thing people say. No one says, "the sky was icy."

/4
He fought me when I asked him on cross: "Isn't it true that 4.6 inches of snow fell that night in Queens county?" I asked if seeing a certified weather report from NOAA from that night detailing how much snow fell at LaGuardia Airport would refresh his recollection.

/5
Cop said no, it wouldn't refresh his recollection.

So I said, "that's fine. I don't need you to do this." And then introduced into evidence the certified weather report, had it published to the jury.

/6
Best part was that the photographs these cops took of the accident scene *clearly showed* a lot of snow and ice all over the road! But all the cops kept claiming the roads were clear and there was no snow or ice anywhere!

/7
Jury acquitted. Because when cops lie about details like this, jurors don't trust anything they say.

Testilying is a serious phenomenon, and it is widespread.

Remember that if you are ever on a jury. Many cops lie with impunity and nothing ever happens to them.
