The Waluke case has gone before NINE judges from 2004 till yesterday, and will end in the Court of Appeal, again. 1/
It is very interesting to look at the political angle of the case because whenever tenderpreneurs supply air, and are paid, there is a facilitator and it’s always a politician higher up the public till food chain. 2/
This facilitator can also be a PS or highly wired wheeler-dealer, often a relative of people running the state. So from 2004 till yesterday, with millions looted from state coffers, it’s almost impossible that none in the political higher up was involved. 3/
The other angle worth noting is that this particularly case saw a state institution - NCPB - fighting to save public money. In most instances, NCPB would have facilitated the theft. No wonder some of the richest Kenyans are current & former top managers of NCPB. 4/
That this matter started in 2004 and ends in 2020 (forget it, it will be appealed) tells you how justice is slow in Kenya. A child who was born in 2004, who would have had “uji ya maindi” with this Maize, is today 16, just two years short of adulthood. 5/
Back to the political class. Who facilitated the final payment? Who in the political class had this file? The NARC/Grand Coalition DID NOT pay. The first payment was done by Jubilee? It appears so. 6/
Also, the NINE judges who had this matter. Some threw it away. Some awarded Erad scammers. Who are they? What are they? Could some of them be the ones Pres. Uhuru has refused to employ now? Maybe...or maybe not. 7/
What nailed this case is the Mutual Legal Assistance processes. The world works better as a village. A police officer from South Africa testified. The company whose documents had been forged to claim it stored the maize testified. Everything from SA were forgeries, they said. 8/
Cornered, Waluke said he did not know why Jacob Juma had wired millions to him. He told court he never run Erad, but recieved the millions. Who doesn’t want money? But of course he knew the money was proceeds of corruption. He knew he was looting the state. He knew. /9
