NEW tonight: Trump administration files a brief asking the Supreme Court to wipe out Obamacare, arguing that the individual mandate is unconstitutional and that the entirety of the law must be struck down with it. https://www.supremecourt.gov/DocketPDF/19/19-840/146406/20200625205555069_19-840bsUnitedStates.pdf
The Trump administration SCOTUS brief includes a section explicitly arguing that the ACA’s preexisting condition protections should be killed.
This position is out of step with Trump’s frequent rhetoric that he will protect preexisting conditions. The brief calls for the opposite and he has not offered a replacement plan that addresses the issue.
This would also lead to ~20 million Americans losing their health insurance in the middle of a pandemic without a replacement plan, let alone one with a chance of becoming law.
There’s a reason many congressional Republicans want to drop this issue.

My story tonight for @NBCNews: Trump administration asks Supreme Court to strike down Obamacare amid pandemic, recession https://www.nbcnews.com/politics/donald-trump/trump-administration-asks-supreme-court-strike-down-obamacare-amid-pandemic-n1232203
I know there’s a lot going on but in terms of electoral consequences this might be the biggest news of the summer. https://www.nbcnews.com/politics/donald-trump/trump-administration-asks-supreme-court-strike-down-obamacare-amid-pandemic-n1232203
In a late-night brief, Trump’s Solicitor General tells SCOTUS the ACA individual mandate is now unconstitutional and that it’s “not severable from the rest of the Act.”
Translation: The insurance regulations, subsidies and Medicaid expansion must also go. https://www.nbcnews.com/politics/donald-trump/trump-administration-asks-supreme-court-strike-down-obamacare-amid-pandemic-n1232203

Now is a good time to point out that the five justices who upheld ACA against a constitutional challenge in 2012 are still on the court: Roberts, Ginsburg, Breyer, Sotomayor, Kagan. https://www.nbcnews.com/politics/donald-trump/trump-administration-asks-supreme-court-strike-down-obamacare-amid-pandemic-n1232203
*I should say mostly upheld. Three of those justices substantially limited the ACA’s impact by making the Medicaid expansion optional.
The White House is out with a statement this morning blasting the ACA and calling on Congress to work with the Trump to replace it. The president has not endorsed an alternative.
