Feels like this should be a big story:
In the middle of a pandemic, Texas and other states experiencing a surge in coronavirus cases filed a brief today asking the Supreme Court to invalidate the entire Affordable Care Act.

And there it is: The Trump administration just did the same.

It’s nearly impossible to not chuckle with this argument, but the U.S. government is making it:
DOJ says that when Congress zeroed out the tax penalty associated with the law’s individual mandate, the mandate became unconstitutional and the rest of the law must fall with it. https://twitter.com/mikescarcella/status/1276343484014907394

One open question is whether the Supreme Court will put this case at the front of the queue and hear it first thing in October.
I hope it does. The public deserves to see and hear the Trump administration’s position ahead of the election. https://twitter.com/scotusblog/status/1276356102024843264
