This not the way our system is supposed to work...
I think (the Flynn case) is sort of a demonstration of that in my opinion, and also based on my years of practice in the american legal system that the wheels are coming off,
we're going to start to see these strange + unfortunate political battles more + more waged in the judicial system which really goes contrary to the principle of rule of law in my opinion.
it's the prosecutor in which the discretion to prosecute resides, not the judiciary -- there's a fundamental separation of powers there,
and in this case the DOJ is part of the executive branch, not the judiciary.
So when the judge comes in and says "I'm going to appoint a special prosecutor to argue for a prosecutorial position against Gen. Flynn, then the judiciary is assuming the mantle of the prosecution, mixing the branches powers when they must remain separate and discreet.
They way I see it is that you've got various factions of the Deep State, which are doing open battle with each other
-- in this case you've got an Obama - appointed judge, and by the way the D.C. Circuit was split 2-1 along political lines,
you had a Bush appointee and a Trump appointee that were in the majority and you had an Obama appointee dissenting, writing an opinion that Judge Sullivan was correct in what he did.
It's not unusual to see ideological splits in judicial decisions, but i think this is really a naked exposition of two warring factions of the Deep State, going at each other and it raises all sorts of questions in my mind --
why were these charges even brought in the first place --? it suggest to me certain troubling things about Trump's DOJ in the beginning, that they felt comfortable bringing these trumped-up political charges against a Trump ally from the beginning
and then the nature of the DOJ changed enough so the DOJ agreed to dismiss the charges but it just shows the level of infiltration and intrigue going on between these disparate factions --
they really are in a war for survival, I think they're doing everything they can to push their ball forward facts of law and principles of justice + the Constitution be damned.
