(Thread) Supreme Court decision in @OfficialNDCGh v A.G. & @ECGhanaOfficial

Relief 1, i.e. the power of the E.C. to compile a register of voters once and revise it periodically as may be determined by law is STRUCK OUT as WITHDRAWN.
Relief 2, i.e. the power of the E.C. to compile a voters register which power must be exercised subject to the protection of the right to vote is GRANTED. Thus, all persons above the age of 18 can register under CI 126.
Relief 3, i.e. persons who have existing Voter I.D.s have an accrued right and cannot be divested of their right to vote under subsequent legislation arbitrarily and capriciously is GRANTED subject to a Voter ID issued under C.I. 126.
Relief 4, i.e. existing Voter I.D.s, are valid for purposes of identifying persons in the exercise of their right to vote is DISMISSED. Consequently, the existing Voter ID card is a not valid form of identification for the proposes of compiling a new voter register.
Relief 5, i.e. the exclusion of the old Voter ID as proof of identification to enable a person to apply for registration in the proposed voter registration exercise is DISMISSED.
Relief 6, i.e. the exclusion of the old Voter ID as proof of identification to enable a person to apply for registration in the proposed voter registration exercise is arbitrary, capricious and unreasonable, is DISMISSED. This is because E.C. has provided an alternative in CI 126
Relief 7, i.e. proof of identification for registration as a voter should not be limited to the provisions of CI. 126 is DISMISSED subject to the provisions of C.I. 126
Relief 8, i.e. an order directed at the E.C. to include all existing Voter I.D.s as proof of identification in registration exercises for public elections is REFUSED.
This is because the E.C. has the mandate to perform its functions and will only be compelled to act in a particular manner if there is clear evidence that it has acted unconstitutionally.
By the decision, the @ECGhanaOfficial has been directed to commence the compilation of the new voters register as scheduled.
