Mayor @JennyWilsonUT sent this letter to the governor asking for the face mask requirement.
In Mayor Wilson’s tweet she said “local govt must ask “permission” when COVID-19 health orders are more restrictive than the state’s.”
. @abc4utah believes @JennyWilsonUT is referring to SB 3004, the COVID-19 Health and Economic Response Act. People interpret it to mean, local govt. must seek permission from the gov. to enact any additional coronavirus restrictions that are more strict than his orders.
BUT look closely. The bill says:
“If the governor adopts, by order, a recommendation made by the commission, the adopted recommendation supersedes any portion of a local ordinance or order that is more restrictive than or in direct conflict with the adopted recommendation…”
What does this mean? Late Tues night @GlenMillsABC4 spoke with the Utah Association of Counties, who insists the law is being interpreted the wrong way, and the mayor does have the authority to enact the mandate. A legislative lawyer said the same thing.

Argument: commission never made a recommendation on masks, so there's nothing to be more restrictive than. Meaning, @JennyWilsonUT @slcmayor don’t need to ask @GovHerbert's permission to make mask-wearing mandatory bc the commission never made a recommendation (according to UAC).
. @GlenMillsABC4 has already contacted Wilson and Mendenhall’s communication personnel about this. We’ll be looking more into this later today and try to get some answers for you all.
