I'm wondering whether & the extent to which Bolton negotiated a contractual indemnity w his publisher for lawsuits by the Trump admin. The thing is, even if they indemnified him from civil suits or agreed to pay his legal fees, they can't indemnify him from criminal prosecution. https://twitter.com/pwnallthethings/status/1273367465414844417
With this in mind, if the DoJ indicts Bolton, he should immediately sue Bill Barr and Donald Trump personally in a civil suit alleging defamation and slander. There would be huge overlap between the civil suits and the criminal prosecution and, viola, he gets his legal fees paid.
... maybe. The contractual indemnity might not cover the situation where Bolton sues them. But annnyyyway, Bolton should still sue them because the civil discovery would be loads of fun, and he could demand depositions and here's what makes it a very real threat...
.. Within a few months, Barr and Trump could be out of office and no longer have all the resources of the US Federal government standing behind them. Then, they would face genuine legal and monetary exposure, PLUS ...
... plus, incoming Biden admin MIGHT choose to drop the criminal case against Bolton (though, seriously, they might not, bc that would look an awful lot like the Flynn situation, plus Bolton isn't exactly a Democratic sympathetic character.). But he is just someone coming clean.
Also, it seems worth pointing out that Trump has a problem in these lawsuits--he must either definitively claim
1) the information in the book is false, or
2) admit the info is true, and claim that Bolton breached the NDA and/or NatSec classified info laws.
Can't do both.
My light weight analysis here was more strategic political. For a legal analysis of the DoJ's attempt to enjoin the publication of Bolton's book, here's a good thread. https://twitter.com/AlexanderAbdo/status/1273322296812474371
