So some people are asking me what a Nikkah contract contains. Here are some important parts of a Nikkah contract.
1. Offer and Acceptance of Marriage
2. Consent of the Guardian
3. Mahr - How much and when it is due to be paid.
4. Other rights stated below👇
Rights and Responsibilities in the Marriage: Spouses can agree on what they each expect from each other and whether or not they'll like to take on some responsibilities or forgo their rights. Finances, Running of the household, parenting and so on comes under this.
Right to Divorce: This entails a woman stipulating whether or not she retains the right to Talaq if any of the other agreements in the contract are not fulfilled. If she stipulates this, she won't have to go through Khula.
Right to Custody of Child/Children: This is self explanatory. It stipulates who retains the right to Custody upon divorce and under what conditions.
Right to Spousal and Child Support upon divorce: This is also self explanatory. It entails whether or not spousal and child support will be paid, how much of it, one-off or in installments and under what conditions it would be paid
Right to Work: if the woman would love to work or run a business, she can stipulate this to prevent a situation where she would be deprived of exercising this right.
Right to Pursue an Education: A woman who intends to continue to study can stipulate this in a contract and be specific about details which may include travelling to pursue an education.
Polygamy Clause: Here, a woman can stipulate whether or not she is willing to settle for a polygynous marriage
Any other important part not covered here can be included by the spouses.
Finally, it should be attested by two witnesses, duly signed by both parties.
